Wolpoff Abramson MBNA Upton Cohen Slamowitz Lawsuit? HELP PLEASE

Hello - I am new to this board and would greatly appreciate any help or advice that anyone can give me as I am in quite a bind right now...I was recently sent papers from MBNA and Wolpoff (W&A) --- who are I hear are real sharks --- or the local law firm/ collection agency they referred it to (Upton Cohen & Slamowitz) regarding an approximately $5500 debt on an MBNA account...which they now claim on the filing papers to be $7500 ($2000 fees for phone calls and letters that I didn't respond to...?) in less than a year...!?? I need to know what I should do....I am fairly young and don't know if I should go the bankruptcy route or not, which I would prefer not to do if possible...I don't have much other debt but I am not working now and have not for a while so they can not garnish any wages plus I have no assets (no car, no home)...I would be able to settle with them for maybe 50% which I figure they would like to get rather than see me file bankruptcy and then they get nothing....Advice, please! I need to know soon....I would appreciate anyone who can steer me in the right direction!

by the way I am in NYC... oh, also, I thought I might add that I was never properly served any papers for the upcoming court date, I only received one in the mail and one was left at my apartment but they never served me any papers, so I don't know he particular legality but from what I read W&A and their NY affiliate Upton Cohen & Slamowitz are some of MBNA's most ruthless slime and I want to know how to approach this...I never responded or called them after their b.s. arbitration papers because I thought it would be futile, so please anyone with advice please reply to this thread as soon as you can!!
