You need an attorney. Going to court and telling them that you committed FRAUD is not a good idea. They can press criminal charges. This is nothing to take lightly. I don't know how you plan to keep this from your husband, but if you can manage it go for the bk. In bk, the debt can be discharged, stop the law suit, and maybe you won't have to deal with the fraud. Attorneys for the plaintiff need never know about the fraud, maybe you can keep it from your husband too. He will have to attend the creditors meeting though, and the law suit might be mentioned. Filing for bk will also release the money in your bank account. Get a bk attorney to file before court date. That will be the best way to go. Good Luck. Maybe some others will chime in, but that is my 2 cents anyway.
