You might want to check about the SOL on fraud, because it *might* be tolled due to the fact that it wasn't discovered until recently. You'll have to check your state statutes on credit card fraud and any reference to a statute being "in repose."

You may also want to check to see if you can plead the fifth amendment to prevent self-incrimination if you go to court. That may be a way to address the fraud issue without handing the plaintiff a rope. I'd suggest finding a good attorney for advise.
