Does anyone know whether or not the statute of limitations to file a lawsuit on open accounts (credit cards) applies to (1) the state in which one resides presently, (2) the state in which one resided when the account was opened, or (3) the state in which one resided when the account was charged off? For example, I opened a credit card account when I lived in New York more than 6 years ago (NY state SOL is only 6 years). This credit card is in default more than 6 years, but I now live in Ohio, which seems to be the only state that does not have a SOL for open accounts. If a lawsuit is filed, can I have it dismissed on the basis that I resided in NY when I opened the account and when the account went into default?
