That is very true. But Spears vs Brennen is caselaw. MCM will never admit to a debtor that they even know about caselaw and will hold to the actual wording of the FDCPA or statute until you challenge it in court. They're pleading total ignorance with me on the definition of a credit card being an open account (instead of a written account).

I wasn't clear in my posting, so I apologize. My point being that you can't rely on MCM ever producing any documents validating a debt on their own. My bet is that you'd need to file a motion to produce, then ask the court to order them to comply when they don't produce the files. Waiting for them to comply on their own is probably futile.
