Case law trumps statute- that is to say, if case law is different than statute it rules. The courts modify the law with their rulings and that is what stands unless a later.

You have to assert your defenses and cite your legal foundation- they will never do it.

I strongly suggest you get a lawyer to help you. It makes a world of difference- just like the difference in the medical care you get if you are insured vs not insured. You will not regret bringing in a lawyer to help you.
