FDCPA Violations

I just read that any FDCPA case must be brought within one year of the violation(s). Does this apply to a an appeal that's pending against the CA? The case was filed in Appellant Court, January 2004, the CA violated in February 2003. The case will probably be heard in April (I Hope)
