It's possible they've prepared the papers but haven't *filed* them with the court yet. Sounds like they've rolled them up and smacked you across the nose to see how you'll react.

If they can get you to pay up before actually filing the suit, they've saved some money. It costs money to file a lawsuit. And they can always get around the law by saying it was their "intent" to file the lawsuit, but you paid before they could get them to the courthouse.
