I requested verification of my debt from W&A a while back and received some computer printouts of my statements from the past year. The account is 6 years old and thru MBNA. Nothing else was sent. I used the letter on Why Chat's site originally. Thay have now started calling again. I've been working on a letter to refuse the information they sent as verification. I copied the letter below if anyone has any suggestions before I send it to them. All help is greatly appreciated.

Re: W&A File No. 123456789

To Whom It May Concern:

This letter is being sent to you in response to your packet of information sent to me dated January 30, 2004. Under the Fair Debt Collections Practices Act (FDCPA), I had sent a request for verification of the debt you say I owe you. The original letter is included with this letter. As per the FDCPA and recent case law concerning the matter, the information you sent me does not constitute verification of the debt. I now consider Wolpoff & Abramson, L.L.P. to be in violation of the FDCPA, section 809 (b). Further you must immediately remove the collection listing from our credit reports if there is such a listing. Once again this is not a refusal to pay, but a notice that your claim is disputed.

For proper verification of this debt I am requesting the information that is listed below:

(1) Copy of the agreement or contract that bears the signature of the alleged debtor(s) wherein he or she agreed to pay the creditor.

(2) Complete itemization and accounting of all charges and fees attached to the account.

(3) Copies of all statements from the original creditor showing complete payment history of the account.

(4) Agreement with your client that grants you the authority to collect on this alleged debt, or proof of acquisition by purchase or assignment.

(5) Any insurance claims having been made by any creditor regarding this account.

Please also be advised that this letter is not only a formal dispute, but also a request that you cease and desist any and all collection activities. I require compliance with the terms and conditions of this letter within 30 days, or a complete withdrawal, in writing, of any claim. In the event of noncompliance, I reserve the right to file charges and/or complaints with appropriate County, State & Federal authorities, the BBB and State Bar associations for violations of the FDCPA, FCRA, and Federal and State statutes. I also hereby reserve my right to take private civil action against Wolpoff & Abramson, L.L.P. to recover damages.

Sincerely,

John Doe

As you can tell I edited the names and addresses in the letter.
