AUGUST 2003 ?????? Good grief ! There is usually a set time limit for service of process from the lawsuit filing date.

Ok, I'm confused, are we dealing with CO or MS laws ?? Where are you and your son ?? Assuming CO based on your post.

No case or file number ?? Has anyone called the courthouse to affirm that such a suit even exists ?? If a suit was filed almost EIGHT months ago, the case might be dismissable for other reasons besides improper service.

The assumptions of the process server, while he sounds like a complete jerk, are neither here nor there. Keep in mind the mindset and the education level of most of these people. Not exactly Einsteins you're dealing with.

I've re-read the CO statutes on service of process, and I'm afraid you'll have to point out why you think it was improper. From what I can see, it was not. Delivering it into the hands of the defendent is not the only option.
