You are talking apples and oranges. During the requred INITIAL 30 day valiation/disute period if the creditor DOES NOT respond to a validation request/dispute and proceeds with a law suit, YES they can be subject to SEVERE pnalties, as in the case you cited, BUT it WAS NOT a valid debt.

The PURPOSE of validation in the FDCPA is to prevent claims against the wrong people, as in ID theft.

It is true, that you can sue for an FDCPA violation for subsequent non response to a request for validation, but it usually does not get to Court, as the CAs pay off the nuisance suits out of petty cash.
