In Reply to: Is USPS Priority Mail w/Signature Confirmation just as good as CRRR? posted by Nightowl on March 08, 2004 at 13:47:42:
I was writing the following reply, then I realized I might have answered my own question (see below). *********************************************** I always thought that any form of delivery that required a signature was enough to prove delivery. Recently, I was reading a document for a Small-claims court in TX which stated that a USPS certified mail receipt was required to prove delivery. I assume that when it comes to court, it shouldn't matter what form of signature delivery was made if you can provide the signed receipt. After all, a signature is the same whether it's on a UPS, FedEx, or USPS parcel. Can one of the lawyers on this board confirm this? Why would a signed priority mail w/ delivery confirmation receipt be any different than a certified receipt? ********************************************* [Blinking light in my head!] After I wrote the above message, I realized that I have never received the "Original signed receipt" back from UPS or FedEx, and that Priority Mail w/ Delivery confirmation doesn't provide it either. All they provide is a scanned copy of the signature for me to view online. I assume the issue is that the CRRR provides me with the receiver's "Real" signature and not just a "confirmation" or a scanned facsimile. Is this correct? Would a court not allow me to submit a printed delivery receipt from FedEx or UPS? Or does it just depend on the venue?
