Rule # 1: A collector will say anything to get you to send them money- they don't care if your children starve or you can't get to work- just send them money. Rule # 2 Talking to collectors only benefits collectors. Rule # 3 Learn your rights and fight back. Rule #4 Don't ever talk to collectors. See elsewhere in this section of posts for a referral to collection website. Very interesting. To answer your question:
They can NEVER garnish a paycheck for more than 25% of the net amount after taxes. Depending on what state - they may not even be able to garnish at all. Ex. Florida: no wage garnishment if head of household or state employee. Other states limit it tpo 10%. Nothing can happen until and unless they get a judgment in court. Threatening a lawsuit is illegal and you can sue them and they will have to pay you - and your lawyer. Stop talking to them right now. Send them a letter and tell them to only communicate with you in writing. What state? If you are in a one party taping state, start recording the calls and then take them to court.
