File a motion for continuance based on short time of service. In Florida, lawsuit must be served in person and you must be told the nature of the suit- personal injury, landlord-tenant, etc.

You need to check the rules of civil procedure for your state. THis is for the intial filing of the lawsuit if I understand correctly.
