I had a balance with MBNA that was never paid off and they sent it to some arbitration forum, not to mention letting me know after the fact that they did this...then recently they decided to take me to court here in NY. While reading over MBNA's contract stipulations, it says:
[MBNA's caps] "THE RESULT OF THIS ARBITRATION AGREEMENT IS THAT EXCEPT AS PROVIDED ABOVE, CLAIMS CANNOT BE LITIGATED IN COURT, INCLUDING SOME CLAIMS THAT COULD HAVE BEEN TRIED BEFORE A JURY, AS CLASS ACTIONS OR AS PRIVATE ATTORNEY GENERAL ACTIONS."

Does that invalidate any action they take against me in court?
