I don't think so. If this account is only 4-5 months from last payment, MBNA will most likely be able to validate. Some people say that when they ask for validation that they never hear from that CA again, but the account shows up later with a different CA. So, that might work if the account is close to SOL because it is buying time. However, for something this new, I think it is more likely that MBNA or their attorney will do the arbitration thing and ultimately get a judgement. Bankrupcy will stop all of that kind of litigation. Of course, they can just sit it out and see what happens, maybe they will go away.....
