Had a meeting with my attorney today about a summons from a CA. Based on his experience, he is fairly certain the case will be "tossed" due to lack of documentation. In any case, I highly recommend that if it is at all possible, that anyone with concerns or pending lawsuits consult with a local attorney. They not only know your legal rights, but they also have a good idea of how most cases in your area turn out. We now have a plan of attack for this and any other problems that might arise, and I must say I feel better than I have in a LONG time. Embarassment kept us from consulting an attorney sooner - don't let this happen to you. And in case anyone needs to hear it again, my attorney echoed what you hear constantly on this and other forums - NEVER TALK TO A CA!!!!!!!
