I work at a debt settlement company. There are several things you can do but you have to act quickly. Whenever you are served with such notice it is imperative that you show up for the hearing, or make contact with someone who can. These are usually held in the state that the lender is in not your own unless the laws of your state indicate that they must sue in your home state. You also need to look at the contact that you signed with household, or if bought out by GM, then GM. They are incorporated in a particular state. You must follow the rules of engagement for the state that the lender was incorporated in. You should gather together any and all evidence of financial hardship and mail this package as evidence for the hearing to the judge or arbitrator for your case. You can easily contact the court house for the district of the lenders incorporation. This evidence must be given to the judge or arbitrator BEFORE the actual hearing to be considered evidence. You must also remember that the loans that were given to you were given as an unsecured loan. This means that the money was not secured by any material thing accept your beacon score. You must admit that your financial existance has changed and that your life has in some way become more important to you than your beacon score. Meaning that your financial obligations have met up with some life experience that has proven to be more important than dollar bills. This admonition will allow you the space to maneuver in the world of creditors vs. borrowers. You cannot act scared. You must be potent, sure and humble to the laws. You have rights.
