That is correct. It is a violation of the FDCPA to threaten to sue if they don't intend to. Their disclaimer didn't say they would sue you personally, only that they don't in general have to wait to do so. And it is a valid statement. If you think it could be construed as an FDCPA violation, go for it. Maybe you can even find an attorney who would consider it cause for a class action.
