Are you being sued by CitiBank directly, or by one of its assignee CA's? It sounds to me like the original creditor is suing you. Unfortunately, CitiBank is very litigious in IL. Also, you are beyond the $5000 threshold for small claims in Cook County, at least. You are not quite held to the same restrictions of not making motions before trial as I am, if you're in the same county. But you'll still have to pay the appearance fee on the day you show up. In Cook County it is $120 or $140 (forgot the amount of claim where it goes up) and you have to pay the clerk to file the form. I think you can ask for a certain amount of time for a delay, but not more than 90 days. If you don't ask, it will probably be about 45 days. I doubt that the opposing party will object to 45 days. And you *have* to file an answer!! Your answer is due within 10 days after you make your appearance the first time.
