sears did show when my adopted daughter did hers. sat in about 3 cases and left. took appliances is all. (they set a time to pick them up and the judge orders it) if your case is a later one..sears just leaves lol. how stupid. i dont see the point. no one else showed on any of our cases..and the day i went there was about 6. we have a judge..federal district judge does it in texas. where i live..san angelo is the closest one. all he did was ask me a list of questions i had been shown b4..was this correct? was this correct? yes sir. yes sir. fine ,ur done. it is signed later by him..discharged some months later and you get a letter about it. they did take and sell our land..which they got exactly what was owed on it.(it went to a realtor and sold like any other property) the only case my day that had a creditor was on a business BK. poor old people..and a bank officer showed. asked them if they had each piece of stuff..(trucks for trucking bisness--obviously their dream and they lost it) and asked where it was and made arrangements to pick it up. obviously collateral for loans. we were all in a informal room with a long table and chairs around the walls. took about 25 mins for ours. i would never do it without a lawyer, altho some here say they would. too complicated for me and if you mess up..your filing fees r down the drain and you start over. no one at ours filed on their own. they all had lawyers. i doubt the judge would be to supportive to do someones job for them, should they mess up. just my view..i know others feel diff. like i said..creditors i saw were a bank officer..none else. sears was some lady who did her one or 2 and left. strangeeee way to do things. they wont insult you because you all are sworn in..and its pretty polite and respectful by everyone. they say granted but the paperwork comes later in the mail. also...do not hide assets. man if you do, be careful . thats very illegal and not looked upon well at all. also any assets you may come into in (here its 6 months) , will go to the BK and the debts. we were warned..about that. dont come into money or assets. the court will take it. (no lotto winnings) anyways ask away, anything you want since me and JK have gone thru it. others prolly have to here, i just know that us 2 have. good luck--dont be scared. i was intimidated mainly cause it was embarrassing as hell but so was the other people there that day lol. cause you can hear their cases and business..one was a elderly lady..bless her heart. one was a single mother who had just got divorced and they spent more time on her..she was not happy with her ex cause his lawyer was there to see he didnt get shafted. they had some discussions there on that! what do they say? the creditors lawyers? like..is this true? where is this property? they turn in paperwork proving they can take it. make plans when to get it. etc.
