Would this be an open or a written account?

Back in 1998 my DH received an unsolicited check in the mail from Associates Finance. The letter with the check stated that if the check was deposited or cashed he would then have payments of 43.00 per month. He stupidly cashed the check, made a few payments,6 months later he was forced to go on medical retirement. He now has a charge off on his credit report from Associates dated 12/99. I think this account is out of SOL but not sure if it would be an open ended account, 4 yrs. here in Florida, or a written contract, 5 yrs.
Any help will be greatly appreciated.
