I am basically in the exact same situation as Tom - large debt with MBNA, I live in Texas, same basic time line. Wolpoff has filed arbitration case. I sent a validation letter and "refusal of arbitration" letter today. Has anyone had success using this tactic? Is the follow up motion filed in a local court and has anyone had it work? Also, if they can't use arbitration won't they just sue me and get a judgement that way? Any info would be wonderful. Thanks in advance.
