Hi, Background: After being late in payment, Amex raised interest to 28% on $17000 unsecured debt. Anger caused my husband to refuse to pay unless interest was lowered. Amex sent account to RMA. April 5, RMA from NJersey sent first letter. We are still trying to get back on our feet from WTC attack; our 2 person business is in the affected zone. We are barely making minimum payments on other debts, whose interest has also gone up. After doing research I sent letter for validation of debt.(April 20) and to stop calling at our place of employment since we don't allow personal calls there. Their calls have been archived. My husband wants to pay Amex, but in small payments because this is all we can afford. We would like to reach a settlement with Amex somehow. Although we have no personal assets (home etc.); we have business assets which we use to make a living. We don't want to declare BK. We want to get our business back on its feet. Yesterday 4/21, RMA sent another letter, from Ohio offices. As well we receive other collection calls plus a call from "Amex Litigation" dept. Quesitons: Do I send another letter of validation to the Ohio offices of RMA? Do I call back the Amex litigation unit? Anyone with any experience in dealing with Amex and RMA? Can a judgement against us in NY let them take our equipment? Thanks, LittleWays
