Your last payment was in sept 2003? If so did the account charge off?... What you fail to realize about FDCPA Violations is who owns the accounts. If your account charged off and is sold to a collection agency and they use w&a to collect then they have to follow FDCPA. IF MBNA still owns your account and they are using W/A to arbitrate then FDCPA does not apply. The FDCPA does not apply to the original creditor.
