Plus a little more time to fill out summonses for the clerk to issue, and as soon as you have the filing fee, or at least it's that way in most states and the federal system. You can file in federal court if FDCPA was violated and take any TN law violations along with it.

Chances are the CA will cave and settle, or ignore it and get defaulted. If they fight and you have a good case, you will likely win and even if you don't you cost them money to defend it.

How your lawyer gets paid is, if it settles, you have an agreement with your lawyer ahead of time as to how you split it up. If you take it to court and win, you get the damages and your lawyer makes his/her own motion for fees against the CA, probably based on hours spent on the case.

I always take anti-CA cases contingent and haven't been disappointed yet.
