Hi Airics, I am not an attorney but I think here in Ohio you file a Leave to Plea,to get an almost automatic continuance. As I understand it,
your Leave to Plea must include a reason, ie retaining legal council, request a date to answer complaint that is 30 days longer than original answer date, and should include a notice that a copy of your Leave to Plea has been forwarded via regular US Mail, to Plaintiffs Attorney (name) on such and such date.. File one with the court to be date stamped in, and send a copy to Attorneys representing the Plaintiff.
When you take it down to the clerks office to submit it, ask him or her if you should also date stamp the copy being sent to the attorneys for the palintiff. (not sure on this) Take original and two copies to be safe. Have your own copy date stamped in as well.
Good luck, I hope this helps out
Also ask the clerk will you get a notice that your Leave to Plea has been accepted or not, or is it just automatic, not sure on this.
