You file a motion for continuance- list the reason(s) you are requesting it and also ask for a date at least 30 days after your original date. Remember that the judge will probably be seeing this for the first time so you want to include all relevant information in your pleading. Defendants Motion for Continuance for ________ (here you put the heading that is on the summons: ex pre-trial conference, etc) Defendant respectfully requests a continuance for the _____________ (event name) scheduled for _________ Date, time and room if given.
Defenant requests continuance to: put in a specific date here- you will usually get at least a month, but ask for what you want. Reason for request is:
Defendant needs time to obtain legal counsel. Also, follow already given advice and get your copy date and time stamped when you give it to the court. You are doing yourself a big favor as well- now you are not one of the masses going in for the default. If you go to court, you will find out that they probably have 20-30 cases at the same time. Most will default and they will get a judgment that way. Now, they have to come to court just for you- time is money esp to a lawyer. Good luck.
