no, they cant go after her. its his estate..which they petition the court for payment when the will is probated. no will..no property..no estate. my mom didnt have one..i just told her creditors..with a death cert..there is no estate. its their prob to find it..and a court date to ask for their money. they will just threaten ....blah blah..the usual CA blah..but they cant do nothing. when a will is probated..creditors have x amount of time to file in court for their share and a judge decides who gets what. they missed the shot. she doesnt have to pay a dime. and this is only my view...not legal advice!!! just what i went thru with my mom..and dad.
