I have just received a summons to appear with Asset Acceptance as Assignee for Providian (both lovely companies). I have to file my appearance/answer by May 6th. Is it to late to request a validation letter? The last payment on my account was 12/00, they closed it on 6/00 (amount past due was $700 and some change). It was "sold" in 2003 and the complaint against me was filed April 9 for the amount of $4,700 - with an "Affidavit" from some guy at Asset (dated September 2003) stating their proof is attached, which was 1 line stating a date in 2003 and the amount of $4,700. They said $3,800 is principle and $888 is interest, however my credit limit was 2900. Should I file a motion for continuance and then a validation letter? Motion for default cuz they haven't provided any proof with their complaint that I owe this money? Or just show up and hope the judge is nice???
