TEXAS JUSTICE FOR SALE

I am in my own 3 year hell with Farmers Insurance for a judgment they obtained against my social security number. I have never been involved in an accident with Mid-Century or their client. I didn’t discover the judgment until four years later when I obtained a 3-in-1 credit report. I tried to call the attorney who filled the suit; he had since been terminated and was unresponsive. I researched the company Mid-Century insurance of Texas (Plaintiff) and discovered they where owned by Farmers insurance. I wrote a letter to the president of farmers obtained from SEC filings and he responded with “I cannot comment on ongoing legal issues”. I filed a bill of review (pro se) to have the judgment set aside. The insurance company responded with 6 requests for productions with the most ridiculous questions totally irrelevant to the issue. They scheduled three depositions and cancelled two of them (one by letter, one by voice mail) and I cancelled the last because of a 3 day insufficient notice. I sent my request for production with questions such as

1 Provide any and all documentation that a claim
was paid to Mr. Winston Gay

2 Mid-Century filed suit on-behalf of Winston Gay.
Identify Mr. Winston Gay.

3 Provide any police reports or witness statements.

Many more but you get the idea; they refused ALL on the grounds of being irrelevant or overly broad. One month before trial I sent a motion for summary judgment on the grounds they had no evidence to support the judgment and that it was obtained improperly. They in turn sent their motion for summary judgment without responding to mine. Saying I had refused to appear for three scheduled depositions and refused to answer their requests for production. On the day the court was to rule on my summary judgment, Texas county court #3 Judge Hull-Bradshaw ruled granting their motion, refusing to acknowledge mine or give a reason for her ruling. I am currently appealing with little hope. Keep in mind that Acosta, Shrode, and Soule (in-house law firm for Farmers insurance) is listed on the COUNTY CIVIL COURTS web site as a political contributor. I refuse to pay something I don’t owe so I guess Ill have it on my credit for the next 20 years and hope they don’t try and collect. The whole experience opened my eyes and I’m a better person for it, there is no right or wrong, guilty or innocent, fact or fiction, its all about the $$$$$$. The citizens are nothing more than the grease that keeps it all going.

Any thoughts or recommendations will be appreciated although I’m sure I’ve been there and done that. Thanks,
