Why Chat - can you answer a question for me please? I said earlier on this board that I got a summons to appear for Asset Acceptance, as Assignee for PROVIDIAN. They submitted as an Exhibit an Affidavit from an outsourcing manager at Asset (dated 8 months before the court case was filed) that they "purchased" the account from Providian. Providian is not listed as "Assignee" on this Affidavit but is listed as "Assignee" on the summons to appear. So, can they or can't they say they are "Assignee" of Providian and once they "buy" the account do they usually have all the paper work with my history. I am answering this complaint by asking for a dismissal with prejudice and sending request for production asking for all the paperwork.
