Thanks - I have just finished typing my answer to their complaint which I will file with my appearance tomorrow and am mailing a production of documents request certified to their atty tomorrow. In my answer I have asked that their "Exhibit" (the Affidavit from Asset's outsource manager) be stricken (what's interesting about it is that it is dated 8 months before the suit was filed and no where does it list them as "Assignees" of Providian, it clearly states they "bought" the account), that they dismiss the claim with prejudice and that they pay my court costs. In my production of docs I'm asking for all court papers relating to an assigment by Providian giving Asset the right to file a claim, amongst the usual, produce all statements, a contract with my signature, all credit inquiries, copies of their phone records, etc.

Do you know or have you heard of anyone actually going all the way through a trial with them and the outcome.
