calm down hon. :) it will be ok. im in texas also. tell us when the date was you last paid and had the account current with the original creditor. texas has a 4 year SOL. are you sure your in SOL? and we are a non garnishing state..with lots of exemptions. i would say close your checking account. close any savings accounts..they can freeze them here. the lawyer to sue you must be licensed in texas. the CA must be bonded. i just emailed again to check on a bond for a new CA i have. do not let them get a default against you! if nothing else..others here will help you in answering. is this your account? for sure? have you been served? is it on record as being filed??? your not alone. for one thing, demand any and all papers and proof they have to verify its your loan. its called discovery. im sure a clerk will help you, i intend to look and sound hugely helpless if im sued. esp the "im too poor for a lawyer" thing. which i am. lol. i intend to argue the interest rates..and if all else fails..i will have a non enforceable judgement on me. they will be able to get any money in the future such as insurance settlements, death benefits..etc. and they can take your checking account. keep a very small amount it so it doesnt look like your hiding anything. whatever, do not let them get a default against you. may i ask your general region? im in the very middle of texas, by abilene.
