I was served last week with a summons for Asset, as Assignee of Providian. Make sure you file your appearance before the return date on the summons because if you don't they can get a default judgment that day. I answered their complaint with a lot of "deny the allegation" or "have no knowledge". I have a court date on the 20th and unless they have something I don't have they will not be able to support their claim of the amount they listed. I just looked up the laws for small claims court today and found out I cannot ask for discovery before the hearing but I will ask for leave of court at the hearing and ask the judge to have them provide back-up. They have to be able to prove the amount on the suit. Do not enter into an agreement with them before then - go to court.
