If they have MERGED two different accounts into ONE claim, you need to simply ask for the TWO accounts to be claimed seperately. THIS IS YOUR LEGAL RIGHT. Request proof of WHICH account they are filing a claim on, including application copy, accounting of the debt, fees etc. You do NOT need to lie or pretend you don't owe anything to Cap.One, just say "which account are you filing THIS lawsuit on". Most likely, there will be NO ONE there to provide ANY answers, as they expect you NOT to show, and they expect to get a default judgment. As to your motorcycle, changing the title would not do much good, if it is free and clear as this could be considered an attmpt to hide asssets and would get you MORE trouble. It is NOT likely they will know about the motorcycle as they usually check just your report for paid off car loans etc. If you have a joint account with your spouse, and YOUR name and ss# are primary, keep less than $100. in it and re-open another account with your spouse as primary.
