I had a credit card issued to me by Direct Merchants Bank when I was 17 years old (Im 25 now). They sent me the application and I lied on it and said that I was 18. I maxed it out within a few months and never paid on it. It went to Asset Acceptance for a few years, and they handed it over to an attorney. Last week, I found out that the attorney had levied my bank account. They took the $1800 from my savings account that I was going to use for turion for this summer in college. And they took $33 out of my checking account. The combination resulted in me overdrafting 6 times because I could not transfer funds. Luckily I got paid from my part time job and have money to live with for now. The attorney had issued a writ of garnishment, however I never recieved it because they sent it to my previous address. I moved from there over a year ago and changed my address through the post office. So is the writ of garnishment still legal, even though I never recieved it? Also, is there a way to fight the debt since I was a minor when I was issued the card? I know I lied about my age, but shouldn't they have verified it through my SS#? (I'm an honest guy now, trying to make it through my senior year) This has come so suddenly and it has put me into a bad position financially. I have contacted the Attorney Generals office (of Oregon) but its the weekend so I though maybe someone here could give a bit of advice. Thanks!
