It has happened to me. I have a court date 6/4, and a letter signed by the judge. Cohen & Slamowitz sent an information subpena to my job, after I got the letter from the judge. And today they sent a process server to my house with a reuqest for judicial intervention. My lawyer is trying to have the arbitration award dismissed so that we would be in a better position to settle. When my lawyer called Cohen & Slamowitz about these 2 things, they said they were a mistake to disregard them. They were no mistake, it was deliberate on their part. They said MBNA wants 80% because I own a house. When my lawyer told them it's tenancy by entirety, they said they will wait to "win the lottery". Well, the hell with it, I'm filing for BK next week. Enough of this crap. I'm also filing a complaint with the attorney general in NY about them.
