Pending lawsuit, what to do?

I live in Illinois and have just been served for a 7600 Bank of America debt. I will try to come up with about 4000 to settle. My question is what are my chances to settle this when they know they have me over the barrel, and shall I play the threaten to bankruptcy card? If they do get a judgement against me and I have no assets what are the likely problems I will face. Thanks for any input
