She should close her account. AND a Texas attorney can not sue in Florida. Sounds like she is within the SOL, but she can and should demand validation. The homestead is protected in Florida, so unless she has a very expensive vehicle, and/or a lot of money in the bank, she can just tell them to pound sand. Not really a lot they can do to her. I would suggest that she protect her banking info. If she has a savings account, get most of the money out of the bank and put it somewhere else!! If they do sue in Florida (with Florida attorney) and get a judgement, they can freeze or seize her bank account. Protect assets. If your mom is near retirement age, retirement funds are usually exempt from judgement.
