If this account was charged off in 97, it is passed the SOL, even in a state with a 6 year SOL I don't recall your state. There is a lot of psychology in debt collection, they didn't show up for the hearing, why??? Well, because they probably never intended to show up. A lot of people get scared when they are served ( I did, and I had an attorney) so they will call and try to make payment arrangements. The CA will then bully them into coming up with a large sum of money and payments and the uninformed consumer thinks the CA is doing him a favor. If you did not sign an agreement, the account is passed the SOL, (making a payment does not restart the SOL) and you can and should tell them to go pound sand. STOP PAYING. Send them the SOL letter if they bother you again. If they sue after they have received the SOL letter, they truly are stupid. Actually, you can also remind them that they filed a time barred law suit against you and wasted the courts time.
