What do you consider disputing the claim legally? I'm to understand anytime you receive a Dunning Letter you have the legal option of disputing as per their letter and they are to validate the debt as per the FDCPA. If they are collectors acting on behalf of a client then I would also think in your dispute they would have to provide proof and evidence of the debt and evidence or proof of the amount they post in their dunning letter. Seems to me this could only be done via the OC and can only be done in first person by someone that has first hand knowledge of the debt and its accounting history. This would have to be attested to via someone that is actually telling the truth and is willing to have his or her signature presented via affidavit in accordance with 28 U.S.C. Section 1746. Doesn't take the IRS anytime at all to have taxpayers sign under penalties of perjury does it? When you dispute the debt you dispute everything about it including the amount and the accounting inaccuracies associated with the purported alleged debt. Why wouldn't the OC have to produce something to you within the 90 day period of time? It seems that's the problem with us debtors, we don't go far enough with these bottom feeding rats.
