You do not have to state your intent to appeal at the time the decision is made by the judge.

Time frame depends on the state. In Florida, you have 30 days from the official decision by the judge to file a notice of appeal with the courts. Then you have 90 days from that date to file your first set of papers.

The appeals process is expensive and complicated. You should put your efforts into winning the lawsuit.

In all states, the losing party is given time to either request a new trial or request an appeal.
Time depends on the state rules.
