I've been doing research all week about my small claims suit coming up next week - Asset, as "Assignee" of Providian. For any of you getting sued in small claims court in IL, I just found a few more interesting laws: Illinois Code of Civil Procedure
§5/2-403 Who may be plaintiff - Assignments - Subrogation (a) The assignee and owner of a non-negotiable chose in action may sue thereon in his or her own name. Such person shall in his or her pleading on oath allege that he or she is the actual bona fide owner thereof, and set forth how and when he or she acquired title. (which of course they did not do) §5/2-416 A corporation may prosecute as plaintiff or defend as defendant any small claims proceeding in any court of this State through any officer, director, manager, department manager or supervisor of the corporation, as though such corporation were appearing in its proper person. No corporation may appear as assignee or subrogee in a small claims proceeding. Interesting if I must say so myself.
