I was awarded a judgement in small claims court. The defendant was to return to court on a certain date at a certain time with the finish product that I have orginally sued him for. He did not show so the judge granted my judgement in lieu of the testitomy. Later I receive a notice that the defendant filed a notice to vacate the judgement because he showed up at court at the wrong time.He state he was confused on the time. Is it up to the judge to determine if this cause is sufficient to vacate the judgement?
