Land will be snatched by these ding-toed dirtbags, even in FL and TX. Homestead protects just that, homestead. FL constitution protects homestead even if funds used for purchase derived from actionable or criminally prosecutable acts.
In other states, be careful. Pay cash, buy through straw buyer. You could buy through corporation or partnership, particularly if limited partner. But, watch your tail. Homestead constitutionally protects owners, not corporate or partnership entities; if they catch on, sue you for fraud. Homeowners have rights, entities don't. Goes for the tax cap as well.
Google 'badges of fraud' to see if you can buy with cash in safety. You've more options than initially apparent. Put it in your brother's name. If you've no brother, adopt one, or find another sympatico relative. Maybe the serial killer with the heart of gold, down the block. No fraud there. Simplest methods of attack always those in plain sight. Don't buy in your name with cash, then title property over to a friend or relative, let them buy with cash or check, you reimburse them. Otherwise, Fraudulent Transfer of Assets Statute applies. It sounds ominous, nope, you won't spend summers sharing shower tips with the gangstas in the State Hotel, it simply means you get to walk around free, happy, minus your recently attached property. Be cautious.
