What they served me with was actually an UNfiled complaint (WA law allows this). Here you have to demand that they file (I did) and filed WhyChat's SOL defense in my answer. The evidence they submitted with their complaint was their usual Outsourcing supervisor statement that they bought it and sent the debt to a collection attorney. They also included an old CC bill, that is mine, but doesnt list any date of last payment(I'm certain this is probably the only record they have). They didnt file in small claims on this one. And I dont have a court date, should I ask for one now? I was gonna hit em with a set of interrogatories to see their evidence and then hope for a motion of dismissal. Will a judge actually read my answer and dismiss it, or does that have to happen at a hearing?
