WhyChat, I posted as Dave previously in reference to the Asset Acceptance suit. I did file your SOL defense in my answer and filed it appropriately. My question is, does a judge actually read my answer and dismiss it after I filed it, OR does this have to happen at a hearing?

Basically, In my answer I stated the SOL defense and asked for a dismissal but do I need to ask for an actual hearing and point out what I stated in my answer for this dismissal to happen? Will a judge read answers as they are filed or can he only do this in open court or a hearing?

I understood that action on a case only happens at hearings, is this true?
