Placed for Collection

Hello
Ran a credit report and there was something that is NOT ours that has been placed for collection. I called the collection agency and there is SOMEONE else's name on the account that has been placed that we do not know. My questions are: We were NEVER notified by this collection agency - is that legal? Can something be placed for collection and the person(s) being collected against never notified? ALSO, I was told to write a letter to their LEGAL dept and that it would take SEVEN TO NINE months before I would get a reply! I'm trying to refinance my home and can't get anything done until this is cleared up. I sent a letter OVERNIGHT to the legal department requesting verification and explaining that this is not OURS.
PLEASE HELP!!!! Thank you!
