Sometimes, the opposing side will decide to dismiss a case based on your pleadings. (Not often, but it has happened)

Judges usually don't see anything until the parties are standing in front of them. At that time, they rely on the parties to present their side of the argument. You still have to have the motions filed with the court.

Sometimes the judge decides right away, other times, you get the answer in the mail

In the cases I have done, the plaintiff attorney usually scheduled the motion to dismiss for a hearing.

Every state and every county is different so check with your court to make sure of the proper procedure.
